Under French Commercial Code “Code de Commerce” commercial leases are signed for a minimum period of 9 years.
Except special circumstances (see below) owners cannot terminate lease until this 9 year period has elapsed.
Because French law on commercial leases was initially conceived to protect tenants.
Often when entering a commercial lease, owners do not realise that termination of lease is far from simple even when the tenant is in breach of contract.
First situation the tenant is not in breach of contract
Rents are paid and there is a peaceful occupation of the property
